La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. A filosofia é filha do tempo e reflete a compreensão possível de deter- minado momento histórico. Embora isso pareça banal, não o é. Se a afirmação é justa, deve-se admitir que a filosofia segue o espírito do tempo (Zeitgeist ou a forma mentis) em que foi produzida. Isso torna-a mais próxima da compreensão resultante da pedagogia que a originou e da mentalidade reinante em certo tempo. Partindo da forma mentis que instituiu o ensino no Colégio Serenense no Mato Grosso e (...) na Universidade de Königsberg na Prússia, investigamos dois grupos conceituais: o primeiro, referente à filosofia, ao pensamento e à verdade, e o segundo, à lógica, às ciências e ao método. Nesse sentido, fizemos um estudo comparado entre o Cursus Philosophicus (1756), de Frei Manuel dos Anjos, e o Manual dos cursos de Lógica Geral (1799-1800), de Immanuel Kant. Nesse estudo, a questão central é entender se as similaridades e diferenças entre os escritos dos dois filósofos permitem compreendê-los como escritos verdadeira- mente filosóficos ou se o Serenense seria representante apenas de uma filosofia precária, sem densidade, rala e de segunda mão. This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

With their book Logical Pluralism, Jc Beall and Greg Restall have elaborated on their previous statements on logical pluralism. Their view of logical pluralism is centred on ways of understanding logical consequence. The essay tries to come to grips with their doctrine of logical pluralism by highlighting some points that might be made clearer, and questioning the force of some of Beall’s and Restall’s central arguments. In that connection seven problems for their approach are put forth: (1) The Informal Common (...) Core Problem, (2) The Formal Common Core Problem, (3) The Superior Judge Problem, (4) The Problem of the Conditional, (6) The Problem of an Unsettled Concept of Consequence, (7) The Methodological Problem, (8) The General Logical Form Problem. It seems that the case for logical pluralism is far from clear. It is even unclear what exactly logical pluralism is and where is stops. It is also unclear if logical pluralism could be stated as it is, if it were true. So far universalism seems to be the better position to take. (shrink)

Conceptual engineering is commonly characterized as the method for assessing and improving our representational devices. Little has been said, however, on how best to construe these representational devices—in other words, on what conceptual engineering should be all about. This paper tackles this problem with a basic strategy: First, by presenting a taxonomy of the different possible subject matters for conceptual engineering; then, by comparatively assessing them and selecting the most conducive one with a view to making conceptual engineering an actionable (...) method, that is, a method that can be applied effectively and consistently to specific case studies. The outcome is that conceptual engineering should be all about concepts on pain of pragmatic inconsistencies otherwise. (shrink)

In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. In this work we provide a new topological representation for implication algebras in such a way that its one-point compactification is the topological space given in [1]. Some applications are given thereof.

The purpose of this talk is to reassert the philosophical significance that the DEL notion of an announcement may have, by (1) drawing an epistemologically motivated double distinction a. between "assertions" and "announcements" on the one hand, b. "public" and "private announcements" on the other hand, by (2) bringing it to bear on two "Moorean Puzzles" - Moore's Paradox and Moore's Proof - that we propose to revisit, thereby (3) contributing to grounding the logic of announcements in the philosophy of (...) knowledge. English summary: How Niccolo Machiavelli is to be understood is still passionately argued today. The many facets of his political thought correspond to the diversity of perspectives among his interpreters. The authors of this interdisciplinary volume analyze Machiavelli's works in connection with transformations of thought on policy, rule and morality from the beginning of the early modern period through to the present. In addition to the interpretation of Machiavelli through the lens of his time, effects of his writings and thought (...) in contemporary discourse are focused upon. Topics not only include Machiavelli's relationship to the modern concept of the state and his experimental morality, but also his demonological style of reading and his presence amongst contemporary republicans and liberals, amongst thinkers such as Max Horkheimer and Michel Foucault, as well as in the empire debate. Different authors of Fregean inspiration have argued recently for the need of resorting to senses in order to explain successful communication. Such arguments have led some philosophers to develop theories of sense which include some of the externalist insights brought up by neo-Russellians. In this paper, we argue that these theories of sense don't work. We also present a broadly neo-Russellian account that explains away Fregean puzzles on communication without resource to entities like senses.

This essay takes up the question of a “new” social paradigm by first examining the recent emergence of the U.S. Occupied Movement (OM) as a provocative and inspiring moment of political re-composition, but one that also narrates a more complex unraveling of what W.E.B Du Bois called “democratic despotism.” The most recent political tensions and economic “crisis” of the global north point to the disruption of a white “middle class” hegemony alongside inspiring moments of reconstructed conviviality. I suggest that the (...) tension within spaces of occupation and convergence are animated by conviviality that should be read “politically” by noting the emergence of tools in service of community regeneration. Towards that end, I introduce Universidad de la Tierra Califas, a local project somewhere in-between network and collective pedagogies that is also a project of strategic conviviality and a Zapatismo beyond Chiapas. I argue that UT Califas engages a collective subject as part of an epistemological struggle inspired by Indigenous autonomy currently underway throughout Latin America. (shrink)
